Terms & Conditions of Sale – Online Ticketing for Château Montbéliard Würtemberg

Preamble:

By using the online ticketing service of the Museums of Montbéliard, you (the “Buyer”) accept without reservation all of these Terms & Conditions of Sale (the “T&Cs”). These T&Cs set out the contractual provisions between, on the one hand: the Museums of Montbéliard (hereinafter referred to as the “Seller”), represented by the City of Montbéliard, domiciled at Hôtel de Ville, BP 95287, 25205 Montbéliard Cedex, France; and on the other hand: any natural person or legal entity (hereinafter referred to as the “Buyer”) wishing to purchase admission tickets for Château Montbéliard Würtemberg, the Hôtel Beurnier-Rossel Art & History Museum, for special events, workshops and other activities organised by the Museums of Montbéliard.

The purchase of electronic tickets implies the customer’s full and unconditional acceptance of these Terms and Conditions of Sale (T&Cs).

ARTICLE 1 – Nature

Tickets may only be purchased by individual visitors.
 

Only tickets purchased on the official online ticketing site (chateaumontbeliardwurtemberg.tickeasy.com) are valid and accepted at museum entry checkpoints. Any ticket purchased outside the official ticketing site will be refused.
 

The online ticketing site may offer the following types of visits:

Admission tickets

Admission plus guided tour tickets

Workshops

Annual memberships

For any given activity, the maximum number of tickets purchasable online is limited to five (5) per type of service or per visitor category (for example: 5 full rate tickets, 5 reduced rate student tickets, 5 free admission tickets for visitors with disabilities…).


The website informs the Buyer of availability of these events at the time of booking. The “Cart” page enables checking of the current order. The order content may be modified up until the payment is processed.

ARTICLE 2 – Rates

Rates are set in euros by the Deliberative Assembly of the Municipal Council of the City of Montbéliard. The applicable rates are those in force at the time the order is placed. The Museums of Montbéliard reserve the right to modify the admission rate at any time.

Buyers eligible for reduced rate or free admission tickets (unless part of a free-for-all programming event) must present a valid proof of eligibility at the museum welcome desk and at the ticketing checkpoint. If the proof of eligibility is not presented or is non-compliant, access will be refused and no refund will be given.

Once the order is approved by the Buyer, the Museums of Montbéliard cannot retroactively apply discounts or give free admission benefits. Thus, once your ticket is purchased online, you waive any discount or free admission to which you may have been entitled.

In the event of partial closing of the museum tour, construction work, or reduced opening hours, rates remain unchanged. No discount or refund of the online-purchased ticket is possible.

ARTICLE 3 – Availability of Online Tickets

Ticket sales for visits, workshops and other events are carried out in real time. The Buyer is informed of availability at the time of order.

The day and time slot for the chosen visit appear on your ticket.

The entry ticket to the “Historical Tour of the Château Museum” grants self-guided access to the Historical Tour and also access to the Hôtel Beurnier-Rossel Art & History Museum. This ticket is valid for up to one year (365 days) for access to the second museum, from the moment of the first ticketing checkpoint at the first museum. Only one entry per museum is permitted.

The “Hôtel Beurnier-Rossel Art & History Museum” admission ticket grants access only to that museum on a self-guided basis.

The Museums of Montbéliard offer for sale on their site a predefined number of timestamped tickets and reserve the right to increase or reduce the number of tickets on sale.

Tickets are sold for a day and time slot chosen by the Buyer for the Château Montbéliard Würtemberg Historical Tour. Visit to Hôtel Beurnier-Rossel is without prior time slot booking during its opening days.

ARTICLE 4 – Ordering and Validation Procedures

The Buyer places an order on the online page https://chateaumontbeliardwurtemberg.tickeasy.com

The ticket acquisition process is described as follows:

Create a secure account or log in to your account using your personal ID and password. This may also be done before finalising the order.

Creating an account requires submission of necessary information for the forthcoming order: surname, first name, postal address, postcode, city, country and email address.

Select the ticket you want.

Choose the number of tickets you want, then add to cart.

Select the desired visit date via the calendar, then choose an available time slot (only for timestamped visits and activities).

Review the order summary displayed. The Buyer may modify the selection or continue shopping.

Read and accept the Terms & Conditions of Sale by ticking the box “I accept the Terms & Conditions of Sale”.

Click on “I agree and pay” to permanently finalise the order.

The ticket order becomes final after payment acceptance by the merchant processing centre. Accordingly, the order is irrevocable and cannot be challenged. In the event of payment refusal by the processing centre, the order is automatically cancelled.
 

A confirmation email is sent to the email address provided at account creation. This confirmation does not constitute an admission ticket. Only the tickets described in Article 5 are accepted at the ticketing checkpoint.

ARTICLE 5 – Presentation and Use of Online-Purchased Tickets

Tickets for visits, guided tours, events and activities grant access only to the specific areas mentioned in the visit description. An admission ticket to the museums may be requested if you wish to extend your visit to exhibition rooms not covered by the purchased visit.

The ticket is printable following receipt of the confirmation email and subject to payment validation. It is sent as a PDF attachment. The Buyer may also retrieve their ticket via their account on the online ticketing site.

The ticket must be printed prior to the visit on plain white A4 paper without modifying the print size. Tickets that are partially printed, soiled, damaged or illegible are invalid. The Buyer is responsible for verifying the number and condition of tickets purchased and printed.

Tickets may also be presented on a smartphone.

In the event of a forgotten, damaged, incorrectly printed or unreadable ticket, the ticket will be considered not valid and non-refundable.

The essential features of the ticket are:

The indicated nature of the visit

The rate in euros including all taxes

 

The start date and time of the visit

The online-purchased ticket is valid exclusively for the indicated nature of the visit and date. If the specified time slot is not respected, the Buyer may be refused access to the self-guided visit, guided tour, special event or workshop and is subject to the same access conditions and waiting procedures as non-ticketed visitors of the exhibit.
 

The ticket is for individual use only. It includes the rate applied at the time of online purchase. The proof of eligibility associated with the rate must be valid on the day of the visit and presented at ticketing checkpoint.

Visitors must arrive at least ten minutes prior to the start of booked events (live shows, lectures, …) or workshops. In the case of late arrival for a self-guided visit, guided tour, workshop or special event, refer to the following point.

Non-compliance with the specified time may result in refusal of access to the museums for the booked service (visits, guided tours, workshops, events) and the Buyer will be subject to the same access terms and waiting conditions as visitors without tickets for all said services.

By concluding the ticket purchase, the Buyer accepts these Terms & Conditions of Sale.

Access to the visit is subject to validation of the ticket bearing a barcode. The ticket is checked and registered using electronic readers. The first person presenting the ticket is presumed to be its legitimate bearer. Access is refused to any other person who shows up afterwards.

Any person illegally reproducing a ticket and/or using a counterfeit ticket exposes themselves to criminal prosecution.

The visitor must keep the ticket on them for the duration of the visit.

If any of the conditions stated in this article are not respected, the Seller reserves the right to refuse access to the relevant visit.

ARTICLE 6 – Payment Methods

Payment for tickets is made exclusively in euros, taxes included.
 

Museums of Montbéliard online purchases may only be performed using bank cards. Accepted cards: Carte Bleue, Mastercard, Visa.
 

Payment is approved via the 3D-Secure standard and after approval of the transaction by the payment processing centre, which checks card authorisation thresholds and the list of lost or stolen cards. In the event of refusal by the processing centre, the order is cancelled.

After payment approval by the merchant processing centre, the client is redirected to a page confirming that payment has been made. From this page, the Buyer may download or print their proof of purchase and their ticket(s).

In accordance with applicable banking regulations, card transaction data is archived for fifteen months from the date of transaction. After this period, the data is destroyed.

ARTICLE 7 – Payment Security

The Seller implements all appropriate measures to ensure confidentiality and security of data transmitted by Buyers on the site.
 

The Buyer’s banking information is protected since only the payment authorisation codes issued by banks are retained. Accordingly, the site uses a secure online payment system to encrypt data transmitted between the Buyer’s computer and the payment server.
 

Personal information and data are necessary for processing your order. These data are also retained for security purposes in order to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of 6 January 1978 (as modified) and European Regulation 2016/679 (General Data Protection Regulation), you have the right to access, rectify, modify and delete data concerning you. You may also exercise your right to object to or limit processing of your data and your right to data portability.

ARTICLE 8 – Cancellation and Refund Policy

Tickets cannot be re-used, exchanged or refunded except in the event of total closure of the site or cancellation by the Museums of Montbéliard.

Change of date and/or time is not possible once payment has been validated except in the event of total closure of the site or cancellation by the Museums of Montbéliard.

In case of cancellation or total closure of Château Montbéliard Würtemberg, the Buyer must contact the Museums’ guest services via the form here.

In accordance with Article L 121-20-4 of the French Consumer Code, ticket sales for entry or associated visits in a museum (classified as leisure services) do not grant any right of withdrawal.

By purchasing a full rate ticket online, the Buyer waives the benefit of any discount or free admission they might have been entitled to for the chosen nature of the visit.

Tickets purchased online may not be resold.

All refunds, modifications or exchanges will be carried out apart from any other compensation.

ARTICLE 9 – Personal Data

Personal information collected during the online purchase is necessary for commercial management with the Museums of Montbéliard and for the following operations:

Processing and tracking of orders

Facilitating your future transactions

Enabling statistical studies
 

Personal data are subject to computer processing and stored in your personal account on our website, accessible using your personal ID and password provided at registration.

The data recorded are only intended for internal use by the Museums of Montbéliard and are never communicated or sold to outside organisations.

In accordance with French Law No. 78-17 of 6 January 1978 (Data Protection Act), as amended, you have the right to access, rectify and delete your personal data. You may therefore request that any information concerning you be corrected, updated, or deleted.

To exercise your rights, you may send a written request to the GDPR correspondent at contact@montbeliard.com specifying your surname, first name and address. Your request must be signed and include a form of ID.

In case of breach of applicable data protection regulations, you have the right to file a complaint with the French National Data Protection Authority (CNIL).

You may consent to receive the Château or Cultural Pole newsletter of the City of Montbéliard at the time of data collection by ticking the relevant box on the registration form. If you no longer wish to receive commercial information or the newsletter, please write to musees@montbeliard.com.

The Museums of Montbéliard use cookies to optimise service quality and usability:

Session cookies, necessary for online ordering, are destroyed when you leave the site.

Persistent (“disk”) cookies gather anonymous data for statistical purposes.

ARTICLE 10 – Liability

You must check the ticket(s) and confirmation of purchase at the time they are issued or received in your inbox. You alone are responsible for the use of the tickets sold, either by you or by a third party.

The Museums of Montbéliard cannot be held responsible in the case if the non-performance or poor performance of its obligations under these Terms & Conditions is attributable to an unforeseeable and insurmountable third-party event or force majeure.

In the event of loss, theft or duplication of a ticket, the Museums of Montbéliard cannot be held liable.

The Museums of Montbéliard cannot guarantee that no error may occur during the Buyer’s use of the website. The site is accessible 24/7 except in the case of closure due to maintenance, repair or force majeure.

The Museums of Montbéliard shall not be liable for any data loss or damage suffered by the Buyer as a result of site access or internet network failure during the ordering process.

Furthermore, the Museums of Montbéliard cannot be held responsible for any malfunction relating to incompatibility between the ticket delivery method and the Buyer’s IT equipment.

The website and all elements therein such as logos, images and content are the property of the City of Montbéliard. Any reproduction or use other than for personal, non-commercial use requires prior request and authorisation from the City of Montbéliard.

ARTICLE 11 – Governing Law and Dispute Resolution

The sale of tickets covered by these Terms & Conditions of Sale are subject to French law. In the case of a complaint, you may contact the Museums of Montbéliard at: https://www.chateaumontbeliardwurtemberg.fr/contact

The parties will endeavour to settle any dispute amicably. If this is not possible, the French court shall have exclusive jurisdiction.
